Terms and Conditions (T&C)

Legal framework for the collaboration between us and you as the client regarding MPU preparation.

The German version of this text is legally binding.

MPU Guru UG (limited liability), as of September 8, 2026

§ 1 Scope and Nature of Services Provided

1. Scope

These General Terms and Conditions form the legal framework for the collaboration between MPU Guru UG (limited liability), represented by Managing Director Patrick Hoffstiepel, and you as the client. They ensure that our contractual relationship is based on clear and fair terms. The sole contracting party is MPU Guru UG (limited liability).

To which these terms and conditions apply: The Terms and Conditions apply to all services we provide as part of your counseling and preparation for the Medical-Psychological Assessment (MPU) as well as, if required in your case, for the medical examination. This includes, in particular:

  • In-person counseling sessions
  • Individual sessions with our psychologists
  • Preparation sessions for the medical portion
  • Seminars and Training Courses
  • Mock exams
  • All other supportive measures for individualized preparation

The provider is MPU Guru UG (limited liability), Kemnader Str. 334, 44797 Bochum, phone 0176 32827631, email kontakt@deinmpuguru.de, registered with the Bochum Local Court, HRB 21825, VAT ID number DE360585252.

The Terms and Conditions apply in the version provided to you prior to your submission of the contract declaration and incorporated into the contract upon its conclusion. Subsequent changes shall only take effect if they are agreed upon in writing by both parties.

2. Type of service provision

Knowledge is imparted exclusively through direct, real-time interaction between the client and the respective specialist, either in person, by phone, or via a live video conference with continuous, two-way communication in real time. Questions can be asked immediately at any time.

Consequently, there is no physical separation as defined in § 1(1)(1) of the Distance Education Protection Act (FernUSG). The Distance Education Protection Act therefore does not apply to the contractually agreed-upon services.

MPU Guru UG (limited liability) does not provide recorded instructional videos, pre-produced self-study courses, or asynchronous distance learning programs. The work and reflection materials provided are intended to prepare for and support the live sessions and do not constitute independent knowledge transfer.

§ 2 Terms of Participation and Cancellation Fees

To ensure reliable planning and provide you with the best possible support, it is essential that we set firm appointment times. The following guidelines clarify how we handle appointments, cancellations, and late arrivals.

1. Cancellation deadline for individual consultations

We prepare each appointment individually and reserve this time exclusively for you.

  • Deadline: Please cancel scheduled one-on-one consultations at least 48 hours before the appointment.
  • Format: Cancellations must be made in writing—that is, by email or letter—or by phone. A cancellation via messaging services is only considered valid if MPU Guru UG (limited liability) confirms receipt in writing.
  • Cancellation fee: If the cancellation is made late or not at all, we will charge a cancellation fee of 91.00 euros (gross).

If you fail to cancel an appointment reserved exclusively for you by the deadline or fail to attend it, the claim for compensation remains valid in accordance with statutory provisions, in particular § 615 of the German Civil Code (BGB). Any expenses saved and any alternative use of the reserved time will be taken into account. The cancellation fee is a lump-sum assertion of this claim and is not charged in addition to it. The same applies to the lump-sum fees in sections 2 and 3.

2. Cancellation deadline for seminars and weekend courses

Why planning certainty is important to us: Our seminars thrive on a limited number of participants, intensive preparation, and personalized materials. To ensure this high level of quality, we prepare everything well in advance and reserve your spot for you.

Here’s what that means for you: If you are unable to attend a seminar you have booked, please let us know at least 72 hours before it begins. Section 1 applies regarding the format of the cancellation notice.

The number of participants in the seminars is limited. The spot you book is reserved exclusively for you and, in the event of a last-minute cancellation, cannot usually be reassigned. When calculating the refund, 30 percent will be deducted to cover saved expenses.

An overview of the cancellation fees:

  • Weekend seminar (2 days): 559.30 euros, instead of the regular price of 799.00 euros
  • Prevention seminar: 209.30 euros, instead of the regular price of 299.00 euros

3. Partial cancellation of the weekend seminar

Our weekend seminars usually take place on the second-to-last weekend of the month, from 9:00 a.m. to 2:00 p.m. If you’re unable to attend on either day, you’ll need to make up that day to ensure your preparation is complete.

Your costs: In this case, we will only charge you for the portion corresponding to the one day that we actually have to reschedule, also minus any expenses saved. Cancellation fee for a single day: 279.65 euros.

4. Options for providing proof when using flat rates

The amounts specified in this paragraph are flat rates. You are expressly permitted to provide evidence that MPU Guru UG (limited liability) has not incurred any loss of remuneration or damage, or that such loss or damage is significantly lower than the respective flat rate. In this case, the amount to be paid will be reduced accordingly. MPU Guru UG (limited liability) reserves the right to prove that the loss or damage was higher.

If the time reserved for you is used for another appointment, the revenue generated and expenses saved as a result will be credited to you.

5. When Life Gets in the Way

Force majeure: In the event of serious accidents, sudden life-threatening illnesses (please provide a doctor’s note), or bereavement in the family, we will of course not charge a cancellation fee.

We’ll find a solution: In justified exceptional cases, we’ll discuss the matter with you. Even though there’s no legal entitlement to this, we often try—as a gesture of goodwill—to waive the fee or find a free make-up appointment.

6. Punctuality and active participation

To ensure you get the most out of our collaboration, we need to dedicate our full attention to your content.

Delays for individual appointments: If you arrive more than 15 minutes late, the remaining time will be too short to conduct the session in a meaningful way. In this case, the right to payment for the appointment remains in effect in accordance with legal regulations. There is no right to a free rescheduled appointment.

Delays in seminars: If you are more than 30 minutes late, we can no longer guarantee that you will be able to follow the material, as the content builds upon previous sessions. In this case as well, the fee remains due; it is not possible to make up for lost time during ongoing seminar sessions.

Our tip: It’s best to arrive 5 minutes early—that way, you’ll start off relaxed and can use every minute to prepare.

7. Online consultations

Our online sessions give you the freedom to prepare at your convenience from anywhere. To make the most of this time, a stable technical setup is essential. Please ensure you have a stable internet connection and a quiet environment, and check shortly before the session to make sure your camera and microphone are working.

Technical issues: If an online consultation cannot be started or continued due to a technical malfunction, we will first switch to an alternative communication channel, specifically by phone or via an alternative platform. If continuation is still not possible afterward for reasons for which you are responsible, the provisions regarding default of acceptance shall apply. If the disruption is due to circumstances within the responsibility of MPU Guru UG (limited liability), the session will be rescheduled at no cost.

§ 3 Terms of Payment

So that you can focus entirely on your MPU preparation, we make the process as simple and flexible as possible for you.

1. Payment Options

Depending on the agreement, you can choose either a one-time payment or payment in installments over up to six months.

2. Accepted payment methods

  • Bank transfer: Directly to the account specified on the invoice.
  • Payment via Stripe: Credit card (Visa, Mastercard, American Express), PayPal (including PayPal installment payments), Klarna (invoice or installment payments).

We’re happy to add additional payment methods upon request.

3. Payment processing via a third-party provider

Online and installment payments are processed through our partner, Stripe Payments Europe Ltd., including integration with PayPal and Klarna. This offers you clear advantages: an immediate start, secure and encrypted processing of your data, and the freedom to choose the provider you trust.

Legal Notice: The terms and conditions and privacy policies of the respective providers also apply to the use of these services: Stripe, PayPal, Klarna.

4. Due Dates and Delinquency

  • For invoices: The amount is due immediately upon receipt, but no later than 7 days thereafter.
  • For payment in installments: Payments are due on time on your specified due date.

Late payment interest: In the event of late payment, statutory default interest applies in accordance with Section 288 of the German Civil Code (BGB). For consumers, the default interest rate is five percentage points above the applicable base rate. The right to claim further damages resulting from default remains unaffected.

5. Late payment on installment plans

  1. If you have an outstanding balance, you will receive a payment reminder in writing with a seven-day grace period to make the payment or arrange an alternative payment plan.
  2. If you do not respond within this time frame, MPU Guru UG (limited liability) may suspend the ongoing preparation until the outstanding balance is paid. In this case, any appointments that have already been scheduled will be canceled; no cancellation fees will apply.
  3. If two consecutive installments remain unpaid in whole or in part, MPU Guru UG (limited liability) may demand payment of the entire outstanding balance. This is contingent upon our having previously set a payment deadline of at least two weeks in writing and having explicitly stated in the same notice that the entire outstanding balance will become due if the deadline passes without payment. At the same time, we offer you the opportunity to discuss a mutually agreeable solution.
  4. Once the backlog has been cleared, preparation will resume. Mandatory legal requirements remain unaffected.

6. Proof of payment

A payment is not considered complete until the amount has actually been credited to our account or that of the payment service provider. Please allow for possible bank processing times when making bank transfers.

7. Certificate of Participation and Digital Delivery

Your certificate serves as formal proof of your intensive preparation for the assessment center and the authorities. We will issue it as soon as all agreed-upon amounts have been paid in full.

Digital distribution: Certificates are issued and sent exclusively digitally via PandaDoc. You will receive your certificate as a PDF file with documented proof of signature. There is no postal delivery.

Redirect: We issue the certificate exclusively to you personally and send it to your email address. We cannot send it directly to the assessment center, the driver’s license authority, or any third parties. It is your responsibility to forward the file by the deadline.

8. Debt collection management through Creditreform

In the event of a significant delay in payment, MPU Guru UG (limited liability) will refer the outstanding claim to Creditreform for processing. The transfer of the data required for this purpose is based on Article 6(1)(f) of the GDPR for the purpose of enforcing outstanding claims. Details, particularly regarding data categories, recipients, and retention periods, are provided in the Privacy Policy.

A credit check conducted prior to entering into a contract must be distinguished from the handover following a delay. If we provide services in advance—for example, in the case of installment payments—we reserve the right to obtain identity and credit information. This processing is also based on Article 6(1)(f) of the GDPR and is described in more detail in the privacy policy.

§ 4 Installment Payments and Payment Processing via Third-Party Providers

1. Legal Classification of Payment Models

a) Direct installment payment: If the parties agree to pay the fee in several installments without interest, fees, or other costs, this constitutes a payment arrangement without charge for the service fee. No interest or processing fees apply.

b) Payment processing via Stripe: If you use Stripe to collect installment payments, Stripe acts solely as a payment service provider. MPU Guru UG (limited liability) remains the contractual partner for the fee claim.

c) Payment via PayPal or Klarna: If you choose a financing or deferred payment option from PayPal or Klarna, you are entering into a separate contract with the respective provider. This contract is governed exclusively by the provider’s terms and conditions, credit checks, disclosure requirements, and cancellation policies. These contracts may be subject to fees and may include interest charges. MPU Guru UG (limited liability) has no influence over the provider’s decisions.

2. Installment payment options in detail

2.1 Stripe: Monthly payments are automatically charged using the payment method on file with Stripe, specifically a credit card. This ensures your payments are received on time and your preparation continues without interruption.

2.2 PayPal: In order for PayPal to approve the installment payment, the provider conducts its own credit check in advance. We have no influence over the result of this check. If PayPal declines the payment, we’ll work together to find another payment method. Typically, the first installment is due 30 days after the contract is signed. PayPal is the contractual partner for financing and applies its own terms and conditions.

2.3 Klarna: Klarna also conducts its own credit check in advance. We have no influence over the result. If Klarna declines the application, we’ll work together to find another payment method. Klarna is the contractual partner for financing and applies its own terms and conditions.

3. Due Dates for Installments

Monthly payments are automatically debited according to the agreed-upon plan. To avoid chargebacks and fees, please ensure there are sufficient funds in the designated payment account.

4. Data Sharing for Installment Payments

To enable installment payments through a third-party provider, we must transmit the data required for processing to Stripe, PayPal, or Klarna. This includes your name, address, date of birth, email address, and phone number, as well as the order value and payment history.

The data is transferred to facilitate the payment method you have selected, based on Article 6(1)(b) of the GDPR. The providers use the data for identity verification, credit checks—including inquiries with credit bureaus—fraud prevention, and technical processing. Further processing is governed by the respective provider’s privacy policy. Without this data transfer, installment payments through the respective provider cannot be offered. The outstanding balance would then have to be paid by another means.

5. Interest and Fees

Contact us directly: If we arrange the installment plan directly with each other, without an external payment service provider, there are no interest charges or processing fees. You pay exactly the agreed-upon amount.

Use of third-party providers: If you set up installment payments via PayPal or Klarna, their terms and conditions apply. Interest may apply. Please review the provider’s current terms and conditions before completing the transaction.

6. Right of Withdrawal for Financing Contracts

If you enter into a paid financing or deferred payment agreement via PayPal or Klarna, you are entitled to a separate statutory right of withdrawal. You must direct this withdrawal directly to the respective provider. You can find the relevant information in the terms and conditions provided by the provider upon conclusion of the agreement. The right of withdrawal for the preparation contract with MPU Guru UG (limited liability) remains unaffected by this.

§ 5 Successful Collaboration and Participation

Successful MPU preparation is a team effort. We provide you with the knowledge, strategy, and psychological support, but you’re the one who has to take the next steps and put them into practice.

1. Active Participation

You agree to participate fully and actively in all booked services, whether in seminars, individual consultations, or the mock exam. What happens between appointments is just as important: It is your responsibility to review the material on your own.

2. Binding nature of appointments

All seminar, counseling, and simulation appointments are fixed and scheduled exclusively for you and are therefore binding. Cancellations or rescheduling are subject to the provisions in § 2. Failure to cancel in a timely manner, a no-show, or arriving late will result in the fee for the appointment remaining due in accordance with the provisions in § 2. In such cases, there is no entitlement to a free rescheduled appointment.

3. Your Personal Responsibility

We’ll provide you with everything you need; it’s up to you to put it into practice. You are responsible for actively using the materials provided and following the recommendations of your psychologist or counselor. If you do not prepare to the recommended extent or fail to follow important instructions, this may jeopardize the success of the process.

4. Editing the preparatory materials

We’ll provide you with preparatory work and reflection materials. These are intended to help you prepare for and structure the content of your in-person sessions; they do not constitute a standalone course and are not a substitute for a counseling session. The materials must be completed before the respective appointment and presented at the agreed-upon time. Only if you are prepared can we work effectively during the appointment and delve into the subject in depth.

5. Exclusion from Sessions

We are working together toward a serious goal. To achieve this, we need a professional, focused work environment and—especially given the nature of our subject matter—absolute sobriety. We therefore reserve the right to exclude participants from sessions or seminars if they significantly disrupt the proceedings or appear to be under the influence of alcohol or drugs.

In such a case, the right to payment for the appointment remains in effect in accordance with statutory provisions; there is no right to a free replacement appointment. The canceled appointment is considered a missed appointment within the meaning of § 6, paragraph 4.

If such an incident recurs after a prior written warning, MPU Guru UG (limited liability) may terminate the contract for good cause; see § 9. Whether the follow-up support guarantee is waived is determined exclusively by § 6; there is no discretion beyond that.

6. Online Participation

Section 2, Paragraph 7 applies to the technical requirements and the handling of technical issues during online appointments.

7. Scope of Services Included

This covers comprehensive preparation for the MPU and, if booked, for the medical examination. The number of hours specified in the offer describes the scope of services available for this purpose. It does not constitute an independent claim for a refund or transfer of individual hours within the current contract. Section 9 applies to billing in the event of early termination of the contract.

§ 6 Post-Service Support Guarantee

1. Legal Nature

The follow-up support guarantee is a voluntary, contractually agreed-upon additional service. If the conditions listed below are met, the customer is entitled to the described follow-up support. The guarantee does not entitle the customer to passing a future MPU, a refund of the fee, or coverage of assessment, government, laboratory, or other third-party costs. The contract remains a service contract pursuant to § 611 BGB. The service provider is obligated to provide consultation, not to ensure success.

2. Scope

The follow-up support guarantee includes a total of three hours, consisting of an internal analysis of the negative assessment result from the MPU lasting up to 60 minutes and two in-person psychological follow-up sessions, each lasting up to 60 minutes. The follow-up support takes place within six weeks after the guarantee is activated, with appointments scheduled by arrangement.

3. Requirements

a) Participation: The client has participated in all booked individual psychological sessions, seminars, and the exam simulation. Appointments missed for health reasons are acceptable provided a doctor’s note is submitted and the appointment is rescheduled within 14 days of the client’s recovery. Appointments missed for reasons attributable to MPU Guru UG (limited liability) or due to force majeure do not void the guarantee.

b) Processing of preparatory documents: The client has completed the provided work and reflection materials and submitted them by the agreed-upon deadlines. If materials have not been completed or are clearly incomplete, the client will be given a one-time opportunity to submit them in writing within ten calendar days of being requested to do so. Only after this deadline has passed without result will the follow-up support guarantee lapse, provided that the lack of cooperation was essential for proper preparation.

c) Implementation of the recommendations: The follow-up support guarantee does not apply if it is clearly evident from the negative assessment result or the course of the assessment that the client deviated from a specifically documented recommendation that was essential to the assessment, and this deviation was a contributing factor to the negative result. Personal nervousness, anxiety, or an unfavorable dynamic during the interview do not constitute grounds for exclusion.

4. Basic Requirements

Regardless of the cause, the follow-up support guarantee does not apply if any of the following basic requirements are not met:

  • The client failed to attend more than one scheduled individual session or seminar day and did not make them up within the agreed grace period.
  • The client did not participate in the mock exam.
  • The required Proof of abstinence was either missing, incomplete, or not in a usable format.
  • The customer has provided MPU Guru UG (limited liability) with inaccurate or incomplete information regarding their substance use, medical history, or legal proceedings.
  • The client did not show up for the MPU appointment.

5. Proof of Eligibility and Utilization

The customer must notify MPU Guru UG (limited liability) in writing within 14 days of receiving the negative assessment result that they wish to claim the follow-up support guarantee and must submit a copy of the expert report / assessment report. If timely notification was not possible for reasons beyond the customer’s control, the period begins when the obstacle ceases to exist.

MPU Guru UG (limited liability) verifies attendance at appointments based on its own attendance records; the customer does not need to provide this proof themselves. We review the application within 14 business days. If approved, we schedule the appointments within six weeks; if rejected, the customer receives an explanation.

6. Goodwill and grace periods

In cases of exceptional hardship—such as serious illness, a death, or a serious accident—we may, at our discretion, waive the deadlines. There is no legal entitlement to such a waiver.

§ 7 Services, Third-Party Costs, and Liability

1. Scope of Services

Our services include individualized psychological MPU preparation, personal guidance through one-on-one sessions, seminars, and simulations, support for the medical portion, and—if booked—organizational guidance regarding applications and documents. This does not include medical services such as diagnoses and medical certificates, psychotherapy under the Psychotherapy Act (PsychThG), legal advice and representation, or the submission of applications to government agencies.

2. Third-party costs

In addition to our fee, there are costs that you pay directly to third parties. We cannot cover these costs nor are we liable for them:

  • Assessment: Fees charged by TÜV, DEKRA, PIMA, and other agencies; laboratory tests; and physician fees
  • Government agencies: Driving licence file, copies, administrative fees
  • Abstinence: Urine or hair analysis in the lab
  • Reissuance: First-aid course, eye exam, passport photo, criminal background check, application fees
  • Other: For example, costs for retaking the written or practical exam

3. Your Personal Responsibility

You are personally responsible for ensuring that all documents are obtained and submitted on time, that fees are paid by the due date, that deadlines are monitored, and that applications are submitted correctly. We provide guidance, but we do not submit applications on your behalf and do not act as your legal representative, unless you provide a separate power of attorney.

4. No guarantee regarding official decisions

We prepare you; the decision is made elsewhere. We do not guarantee deadline extensions or the reinstatement of your license by the authorities, the acceptance of documents, processing times at government offices, expert reports / assessment reports, the recognition of lab results, or the return of your Driving licence file.

5. Liability

  1. Scope of Services: MPU Guru UG (limited liability) is obligated to provide professional, diligent counseling and preparation in accordance with a service contract under Section 611 of the German Civil Code (BGB). A specific outcome of the assessment, in particular passing the MPU, is neither guaranteed nor promised. Decisions made by assessment centers, government agencies, laboratories, and physicians are beyond the control of MPU Guru UG (limited liability).
  2. Unlimited liability: MPU Guru UG (limited liability) bears unlimited liability in cases of willful misconduct and gross negligence, in cases of culpable injury to life, limb, or health, in cases of fraud, in cases where an express guarantee is given, and in all cases of mandatory statutory liability.
  3. Liability for slight negligence: In the event of a breach of a material contractual obligation due to slight negligence, liability is limited to the damages typical for the contract and foreseeable at the time the contract was concluded. Material contractual obligations are those obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance the customer may reasonably rely.
  4. By the way: Liability for slight negligence is otherwise excluded.
  5. Third: No liability is assumed for the conduct of assessment centers, government agencies, laboratories, physicians, or other third parties acting independently of MPU Guru UG (limited liability). MPU Guru UG (limited liability) is liable for its employees and agents in accordance with statutory provisions.

6. Distinction from Legal Counseling

Legal actions such as appeals or lawsuits should be handled by an attorney. We do not provide legally binding information and do not represent you in legal matters.

7. Transparency and Support

Upon request, we’ll provide you with no-obligation cost estimates, checklists for license reinstatement, timelines, and contact information. This is a service intended to help you get oriented.

§ 8 Initial Assessment and Timeline

Binding Initial Assessment: A professionally binding assessment of your situation will be provided exclusively by our psychologist during the initial consultation and once all required documents are available, such as your driving licence file, a negative assessment result, or a certificate of good conduct. Any statements made by consultants prior to this are for initial guidance only.

Duration of preparation: If Proof of abstinence is required, the time frame will be extended accordingly. In addition, the duration depends on your personal learning progress and your willingness to reflect. It is therefore not possible to provide a precise time estimate.

§ 9 Contract Term, Termination, and Billing

1. Contract Term

The contract begins upon the customer’s acceptance of the offer and ends upon the complete provision of the agreed-upon services, but no later than 18 months after the contract begins. After the contract term expires, any unused services can no longer be claimed. The contract term may be extended by mutual agreement in writing.

2. Fulfillment of the Purpose of the Contract

Upon passing the MPU, the purpose of the contract is fulfilled and the agreed-upon fee is fully earned. No refund will be issued in this case. The customer may continue to use any unused appointments during the contract period; MPU Guru UG (limited liability) will keep them available.

3. Notice of Termination

The contract is intended for the provision of a service package with clearly defined content that is individually tailored and ends upon full performance of the services, at the latest upon expiration of the contract term. Therefore, ordinary termination is not provided for. The statutory rights of termination, in particular for cause, remain unaffected.

4. Format and Access

Cancellations must be submitted in writing and addressed to MPU Guru UG (limited liability), Kemnader Str. 334, 44797 Bochum, or to kontakt@deinmpuguru.de.

5. Consequences of Contract Termination and Billing

  1. If the contract is terminated before the contractual purpose is achieved and before the agreed-upon services have been fully rendered, MPU Guru UG (limited liability) will invoice the client for the services actually rendered up to the effective date of termination.
  2. Billing is based on the individual prices listed in the contract’s service overview. An individual psychology session is billed at 130.00 euros gross. A package discount granted upon booking the complete package does not apply to the billing of individual services rendered, as the discount was granted exclusively for the purchase of the complete package.
  3. If the payments already made exceed the final invoice amount, the difference will be refunded immediately. If the final invoice amount exceeds the payments already made, the customer must pay the difference.
  4. Statutory claims for compensation or damages arising from a breach of contract for which the customer is responsible remain unaffected. The same service item will not be billed more than once.
  5. Services that have already been billed for and provided will not be reimbursed.

§ 10 Right of Withdrawal

Consumers have a right of withdrawal in accordance with statutory provisions for contracts concluded through distance selling or outside of business premises. The withdrawal policy and the model withdrawal form are an integral part of the contract document and are provided to the customer in writing prior to the conclusion of the contract.

§ 11 Confidentiality and Service Provision

1. Confidentiality and Professional Secrecy

MPU Guru UG (limited liability) and all employees involved treat all counseling content, personal information, and client documents as strictly confidential. Disclosure to third parties occurs exclusively with the client’s consent, based on a power of attorney granted by the client, or to the extent required by law. This confidentiality obligation remains in effect beyond the end of the contract.

2. Services provided by qualified staff

MPU Guru UG (limited liability) is entitled to provide the agreed-upon services through employed or contracted, appropriately qualified specialists. There is no entitlement to be served by a specific person, unless expressly agreed otherwise.

§ 12 Final Provisions

1. Prices and sales tax: All prices listed are gross prices and include the applicable sales tax, where applicable. Sales Tax Identification Number: DE360585252.

2. Set-off and Setback: The customer may only set off undisputed or legally enforceable counterclaims. The customer may exercise a right of retention only on the basis of counterclaims arising from the same contractual relationship.

3. Jurisdiction and Applicable Law: The statutory places of jurisdiction apply. If the customer is a merchant, a legal entity under public law, or a special fund under public law, Bochum is agreed upon as the exclusive place of jurisdiction. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

4. Consumer dispute resolution: MPU Guru UG (limited liability) is not obligated to participate in dispute resolution proceedings before a consumer arbitration board and does not participate in such proceedings.

5. Severability clause: Should any provision of these Terms and Conditions be or become invalid or unenforceable, in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the applicable statutory provisions.
